1. Introduction and Acceptance
These Terms and Conditions ("Terms") govern your access to and use of the Write To Heal mobile application, together with any related websites, features, content, and services we make available (collectively, the "Service").
The Service is owned and operated by Nita Bajoria, an individual proprietor based in Kolkata, West Bengal, India ("we", "us", "our").
By downloading, installing, registering for, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Refund Policy, each incorporated by reference. If you do not agree, you must not use the Service.
These Terms constitute a legally binding agreement between you and us and form part of an "electronic record" within the meaning of the Information Technology Act, 2000, requiring no physical or digital signature.
2. Definitions

"Account" — the user account you create to access the Service.

"Content" — text, journal entries, mood data, responses, images, or other material you create ("User Content"), and material we provide such as prompts, designs, and graphics ("Our Content").

"Premium" / "Subscription" — a paid plan that unlocks additional features.

"Free Tier" — features available without a paid Subscription.

"Stores" — the Apple App Store and the Google Play Store.

"You" / "User" — any person who accesses or uses the Service.
3. Eligibility and Age Requirements
The Service is intended for users aged 13 years and older.
If you are under 18, you may use the Service only with the involvement, consent, and supervision of a parent or legal guardian who agrees to these Terms on your behalf. By using the Service, a minor's parent or guardian represents that they have provided verifiable consent as required under applicable law, including the Digital Personal Data Protection Act, 2023 ("DPDP Act").
If you are under 13, you must not use the Service or create an Account.
By using the Service, you represent and warrant that you meet these eligibility requirements and that all registration information you submit is truthful and accurate.
4. Your Account
To use most features, you must create an Account. Authentication is provided through our partner (Clerk); you may sign up using email and password or supported sign-in options such as Google or Apple.
You are responsible for keeping your credentials confidential and for all activity under your Account, and must notify us immediately of any unauthorised use.
You agree to provide accurate, current, and complete information. We may suspend or terminate your Account if information is inaccurate, false, or misleading. You may not share, sell, or transfer your Account.
5. Description of the Service
Write To Heal is a personal journaling and self-reflection application. Depending on your plan, it may allow you to write and store private journal entries; record mood check-ins and track mood over time; receive daily prompts and reminders; view insights based on your own entries and mood data; use app-lock and other privacy features; and personalise your experience.
Certain features require an active Premium Subscription (see Section 7). We may add, modify, or remove features at any time. Some data may be stored locally on your device for offline access; you are responsible for your device and for any loss of locally stored data resulting from device loss, damage, reset, or uninstallation.
6. Health Disclaimer — Please Read Carefully
Write To Heal is a self-help and journaling tool. It is not a medical device, and it does not provide medical, psychological, psychiatric, therapeutic, diagnostic, or other professional health advice, treatment, or services.
The Service — including prompts, insights, and reflections — is for general well-being and informational purposes only, and is not a substitute for professional advice, diagnosis, or treatment from a qualified physician or mental-health professional.
Never disregard or delay seeking professional advice because of anything within the Service.
If you are in crisis, experiencing thoughts of self-harm or suicide, or believe you may have a medical or mental-health emergency, do not use the Service. Immediately contact your local emergency services, a qualified professional, or a crisis helpline.
Any reliance you place on the Service is at your own risk.
7. Subscriptions, Billing, and Payments
Plans. The Service offers a Free Tier and paid Premium Subscriptions, currently a Monthly plan and an Annual plan. Exact features, prices, currency, and billing periods are those displayed in the app or on the applicable Store at purchase, and those displayed terms prevail.
Purchases through the Stores. All Premium purchases are processed by the Apple App Store or Google Play Store. We do not collect or process your payment card or banking details — those are handled by Apple or Google under their own terms and privacy policies.
Auto-renewal. Subscriptions renew automatically at the end of each billing period at the then-current price using the payment method on file with the relevant Store, until cancelled.
Cancellation. You may cancel auto-renewal any time through your Apple App Store or Google Play settings; cancellation takes effect at the end of the current period. Deleting the app does not cancel your Subscription.
Price changes. We may change prices or plan structures; changes apply to billing periods after they take effect and are communicated per the Store's rules. Continued use after a change constitutes acceptance.
Free trials and promotions. Applicable terms are disclosed at the time of the offer. Unless you cancel before a trial ends, you may be charged. Only one trial or promo may be available per user unless stated otherwise.
Taxes. Prices may include or exclude taxes as indicated by the Store; you are responsible for any taxes not collected by the Store.
Refunds. Governed by our Refund Policy and the applicable Store's policies; refund requests are generally handled by Apple or Google.
8. User Content and Ownership
You own your Content. As between you and us, you retain all ownership rights in your journal entries, mood data, and other User Content. We do not claim ownership.
Limited licence to us. You grant us a limited, non-exclusive, royalty-free, worldwide licence to host, store, process, transmit, back up, and display your User Content solely to operate, maintain, secure, and provide the Service to you. This licence ends when your User Content is deleted, except for temporary backup copies or as required by law.
Confidentiality and encryption. We treat your journal content as private and confidential and protect it using encryption as described in our Privacy Policy. We do not sell your User Content and do not use your journal content for advertising.
Your responsibility. You are solely responsible for your User Content and must not upload content that is unlawful, infringing, or that violates the rights of others.
Backups. You are responsible for keeping your own copies of important Content; we are not liable for any loss or corruption of Content.
9. Acceptable Use
You agree not to, and not to attempt to: use the Service for any unlawful, harmful, fraudulent, or abusive purpose; upload material that is illegal, defamatory, obscene, or infringing; reverse engineer or derive source code except as permitted by law; interfere with or compromise the Service's security or integrity; access the Service through automated means without permission; circumvent security, access-control, or Premium-gating features; resell or commercially exploit the Service without written consent; or store or transmit malware. We may investigate and take action, including suspension or termination, for any violation.
10. Intellectual Property
The Service — including its software, design, the "Write To Heal" name and branding, prompts curated by Nita Bajoria, text, graphics, and logos ("Our Content") — is owned by or licensed to us and protected by intellectual property laws.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the Service on devices you own or control for personal, non-commercial use. Except as expressly permitted, you may not copy, modify, distribute, publicly display, or create derivative works from Our Content without our written consent. Any feedback you provide may be used by us without obligation.
11. Third-Party Services and Store Terms
The Service relies on third-party services (authentication, cloud storage, push notifications) and is distributed through the Stores; your use of those is also subject to their terms and privacy policies.
Apple App Store (where applicable). These Terms are between you and us only, not Apple; Apple is not responsible for the Service or its content; Apple has no maintenance or support obligation; if the Service fails to conform to any applicable warranty, you may notify Apple, which may refund the purchase price (Apple has no other warranty obligation to the maximum extent permitted by law); Apple is not responsible for addressing claims relating to the Service; Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them; and you comply with applicable third-party terms and App Store usage rules.
Google Play (where applicable). Your use is additionally subject to the Google Play Terms of Service and applicable usage rules.
12. Privacy and Data Protection
Our Privacy Policy explains what personal data we collect, how we use and protect it, who we share it with, and your rights under applicable law, including the DPDP Act. By using the Service, you consent to processing as described there.
13. Account Deletion and Data Retention
You may request deletion of your Account from within the app. On request, your Account is deactivated and scheduled for permanent deletion after a limited grace period, after which associated personal data is purged from our active systems, subject to legal retention requirements. Deleting your Account does not cancel a Store Subscription — you must cancel through the relevant Store (Section 7).
14. Availability, Changes, and Discontinuation
We aim to keep the Service available but do not guarantee uninterrupted, error-free, or secure operation. We may modify, suspend, or discontinue all or part of the Service at any time, with or without notice. Where a discontinuation materially affects a paid feature you purchased, we will act in accordance with applicable law and our Refund Policy.
15. Disclaimers of Warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express, implied, or statutory, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will meet your requirements, be uninterrupted or error-free, or that any insights or prompts will be accurate or suitable. See also the Health Disclaimer in Section 6.
16. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of data, profits, goodwill, or emotional distress, arising from your use of or inability to use the Service.
Our total aggregate liability will not exceed the greater of (a) the amount you paid to us (or through the Stores for the Service) in the twelve months preceding the claim, or (b) INR 1,000. Nothing excludes liability that cannot be excluded under applicable law.
17. Indemnity
You agree to indemnify, defend, and hold harmless Nita Bajoria and her affiliates from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, your violation of these Terms, or your violation of any law or third-party right.
18. Suspension and Termination
We may suspend or terminate your access at any time if you breach these Terms, if required by law, or to protect the Service or other users. You may stop using the Service and delete your Account at any time. Provisions that by their nature survive termination (ownership, disclaimers, limitation of liability, indemnity, governing law) will survive.
19. Governing Law and Jurisdiction
These Terms and any dispute arising out of them are governed by the laws of India. Subject to Section 20, the courts at Kolkata, West Bengal, India have exclusive jurisdiction.
20. Dispute Resolution
Please first contact us at support@nitabajoria.com so we can try to resolve any concern informally. Any dispute not resolved informally is subject to the governing law and jurisdiction in Section 19. Nothing here limits statutory rights you may have as a consumer, including under the Consumer Protection Act, 2019.
21. Changes to These Terms
We may update these Terms from time to time. For material changes we will update the "Last updated" date and, where appropriate, notify you within the app. Continued use after changes take effect constitutes acceptance; if you disagree, stop using the Service.

23. Miscellaneous
Entire agreement. These Terms, with the Privacy Policy and Refund Policy, are the entire agreement regarding the Service and supersede prior agreements. Severability. Invalid provisions are severed; the rest remain in effect. No waiver. Failure to enforce is not a waiver. Assignment. You may not assign without our consent; we may assign in connection with a merger, acquisition, or transfer. Force majeure. We are not liable for failures caused by events beyond our reasonable control. Notices. We may notify you through the app or by email; contact us at support@nitabajoria.com.By using Write To Heal, you acknowledge that you have read and understood these Terms and agree to be bound by them.
